Looking at the numbers provided by the federal government for a recent year, trying to win social security disability or SSI disability benefits in Florida has been no easier than trying to win disability benefits in any other state. And, in fact, it's been quite a bit more difficult in florida than in many states. Individuals who applied for disability in Florida were turned down approximately 65% of the time. Those who filed their first appeal were denied at an even greater rate -- more than 83% of those appeals were denied by the social security administration.

Of course, this is not unexpected. And, in fact, many individuals in Florida who have gone through the disability application process will advise others to expect a denial of benefits on the application and on the first appeal--simply because most claims do get denied at these levels.

Should you automatically assume that your case for social security disability or SSI will be turned down? Answer: you should prepare for it mentally because there is a high probability that it will happen. However, you shouldn't really assume that it will happen. Some individuals who obtain representation from a qualified disability lawyer or non attorney claimant's representative will find themselves in a better position to win their claim. And even if they don't and are forced to request a hearing before an administrative law judge, being represented at this stage of the process typically goes much better when a lawyer or non attorney rep is involved. Many judges, in fact, will advise claimants who show up at a hearing unrepresented that they have the right to representation and this may be construed as a way of saying "come back later with a lawyer, you'll have a better chance of winning if you do".
