Getting a Disability Lawyer in Illinois

Should you consider getting a disability lawyer if you are filing a social security disability or SSI claim in Illinois? The numbers tend to speak for themselves. Two years ago, the federal office of disability programs reported the following information for individuals who had filed disability claims in Illinois. For those individuals who had filed initial applications (the starting point for all social security disability and SSI claimants), the denial rate was 61.2%. For individuals who filed the first available appeal after this initial denial, the numbers were even worse. 87.1% of these appeals were also turned down.

The denial statistics for disability claims processed in Illinois are somewhat staggering as they are in a number of states. Could representation have made a significant difference for some percentage of claimants who were denied? Quite possibly. At the disability hearing level (this is the second step in the appeal process), statistical information indicates that claimants who are represented by a disability lawyer have about a 50% greater chance of winning benefits as compared to those who have not retained the services of a disability lawyer.

Of course, when, or even whether or not, a claimant in Illinois decides to seek out the help of a lawyer to assist them on their claim is a personal decision and a judgement call. Some claimants, it's very true, will never need the services of a lawyer. However, most of these same individuals are also approved when they first apply. Unfortunately, the vast majority of those who are turned down on their application will need to eventually get their case heard by a judge. And, of course, it's always better to be represented by a disability lawyer when appearing at such a hearing.
