Getting a Disability Lawyer in
Michigan
If you are pursuing a social security disability or SSI disability benefit claim in Michigan, is there a "certain time" that you should begin to think about getting a disability lawyer to handle your case?
Answer: the point at which you decide to obtain representation will depend on 1. what has happened on your disability claim thus far, and 2. You (yes, I said "you").
Regarding the first item, you should definitely get a lawyer (or a non attorney claimant's representative will usually do just fine, especially if the individual is a former SSA claims rep or a DDS disability examiner) if you have filed your first appeal and this first appeal has been denied. And the reason for this is plain because the second appeal is for a hearing to be held before a judge. It's simply never advisable to go to a hearing in Michigan without the benefit of representation because your chances of winning unrepresented are substantially lower.
Regarding the second item (the "you" part), the matter of getting representation at certain points in the disability evaluation process can certainly depend on the individual claimant. Claimants who need to have their claim heard by a federal judge are certainly advised to have a lawyer handle their case. But what about using a lawyer before a case proceeds to this level -- is it necessary or needed? And the answer is simply this: some claimants will do fine without representation on an initial application, and some claimants, on the other hand, will benefit greatly from having a lawyer involved earlier in the process.
Of course, one of the benefits of having early representation in Michigan is that, from the moment social security is made aware of the fact that someone represents a claimant, they are put on notice to keep the representative up-to-date on the case. This helps to ensure that nothing important gets missed on the case. Additionally, individuals who are represented on an initial claim and get denied will not have to experience anxiety about completing the necessary appeal paperwork since a lawyer (or non attorney if that's the case) who's handling the claim will submit the required forms well within the appeal deadline.
