Getting a Disability Lawyer in Ohio

Will the use of a lawyer (or qualified non attorney -- many nonattorneys are former SSA field office personnel who are exceptionally competent when it comes to providing representation) increase the chances of winning social security disability or SSI benefits in the state of Ohio? To offer a blanket answer to the question, yes, a lawyer can certainly increase the odds of winning benefits.

Why is this? Because a disability representative, lawyer or otherwise, will know how to properly present a rationale for approving a claim to an administrative law judge. ALJs, as they are otherwise known, hold disability hearings for SSD and SSI claimants who have been denied for benefits. ALJs can be fairly picky when it comes to accepting arguments in favor of approving a case. And for this reason having an experienced lawyer can be beneficial.

What are the odds of winning a social security disability or SSI claim in Ohio. Federal statistics in a recent year showed that for initial disability claims filed in Ohio, 71.1% were denied. At the first appeal level (not a disability hearing but, rather, a review or reconsideration), the numbers are even more appalling. More than 87 percent of first appeals in Ohio were denied.

Such high denial rates present a very depressing picture of one's chances of winning. However, for those same individuals who were denied in the first two steps (of the SSA evaluation process), the chances of being approved in Ohio go up substantially at the third step of the process. The third step is actually the second appeal and is known as a hearing before an administrative law judge.

What are your chances of winning at a disability hearing? Claimants who are not represented by a disability lawyer or nonattorney representative tend to have a 40 percent chance of winning at a hearing while claimants who use a lawyer tend to have more than a 60 percent chance of being approved for SSD or SSI benefits.
